Omnicare Asks For Protection From Expected FCA Suit Flood

Law360, New York (July 3, 2012, 1:37 PM EDT) -- Nursing home pharmacy company Omnicare Inc. asked a Massachusetts federal judge Monday to reconsider her refusal to shield it from kickback allegations in a $421 million False Claims Act lawsuit, saying it’s being treated differently from other companies and could face virtually endless litigation as a result.

U.S. District Judge Rya Zobel last month threw out a large chunk of claims brought by former employees of Organon USA Inc., a pharmaceutical manufacturer accused of colluding with long-term-care pharmacies, including Omnicare, to boost sales of antidepressant Remeron....
