Pa. High Court To Revisit $187M Wal-Mart Award

Law360, New York (July 3, 2012, 8:40 PM EDT) -- The Pennsylvania Supreme Court agreed on Monday to review the use of "trial by formula" in an appeal of a $187 million award for Wal-Mart Stores Inc. employees who were allegedly forced to work off the clock and skip rest and meal breaks.

Pennsylvania's highest court said it would review whether Pennsylvania law was violated when Wal-Mart was subjected to a “trial by formula,” which involves picking a representative set of class members, determining how many valid claims there are and what the claimants are owed,...
