Judge Weighs Damages Issue In Horizon Reimbursement Case

Law360, New York (July 19, 2012, 9:22 PM EDT) -- A federal judge weighing a bid to certify a class of Horizon Blue Cross Blue Shield of New Jersey Inc. insureds who were allegedly under-reimbursed for out-of-network services ordered additional briefing Thursday on the viability of the plaintiff's proposed methods for measuring damages.

Plaintiff Catherine McDonough contends that Horizon systematically under-reimbursed health plan subscribers for out-of-network services because the insurer used a flawed database, Ingenix, to calculate such benefits.
