7th Circ. To Rehear Widower's ERISA Suit Over Medical Bills

Law360, New York (July 16, 2012, 2:09 PM EDT) -- The Seventh Circuit on Thursday agreed to reconsider its rejection of a widower’s lawsuit alleging a health insurance company stuck him with $80,000 in medical bills after failing to clearly state whether his wife’s cancer surgery was taking place at an out-of-network hospital.

In a one-page order, the appeals court granted rehearing by the full court, opening the door to the reversal of a 2-1 ruling in April that largely refused to hold Illinois-based Concert Health Inc. liable for alleged violations of the Employee Retirement Income...
