Motorola Beats Apple Suit Over Qualcomm License Deal

Law360, New York (July 18, 2012, 9:53 PM EDT) -- A California federal judge on Tuesday tossed Apple Inc.’s breach of contract suit over a licensing agreement between Motorola Mobility Inc. and Qualcomm Inc., finding the claim was not yet ripe.

U.S. District Judge Dana M. Sabraw dismissed with leave to amend the suit over Apple's use of Qualcomm computer chips in its products, including the iPhone 4S, that Motorola licensed to Qualcomm under a worldwide patent licensing agreement to which Apple argues it is a third-party beneficiary.
