Magnesium Co. Asks Fed. Circ. To Toss Anti-Dumping Duty

Law360, Washington (August 10, 2012, 2:57 PM EDT) -- Tianjin Magnesium International Co. Ltd. told a Federal Circuit panel on Friday that the U.S. Department of Commerce's decision to level stiff anti-dumping duties against the company over fraudulent duty offsets is an attempt to punish Tianjin for its suppliers' mistakes and should be reversed.

China-based TMI received discounts on its 2006 to 2007 duty margin because of its alleged sales of a manufacturing byproduct called waste magnesium, but it was later revealed that the company had never made the transactions. The Commerce Department ultimately applied...
