9th Circ. Ruling Dooms Pharma Rep OT Suits, Attys Say

Law360, New York (July 23, 2012, 8:55 PM EDT) -- The Ninth Circuit refused Monday to revive putative class action claims from pharmaceutical sales representatives allegedly owed overtime pay under California law, in a ruling that follows a major U.S. Supreme Court victory for the drug industry and that may sound the death knell for such lawsuits, lawyers say.

A three-judge panel refused to resurrect sales representatives' claims in consolidated cases against Bayer Corp., Wyeth and Roche Laboratories Inc., and held that the plaintiffs fell under the administrative exemption to California's overtime wage requirements.
