DHL Says Contractors' FCA Suit Is Preempted

Law360, New York (July 24, 2012, 4:34 PM EDT) -- DHL Express USA Inc. urged a California judge Tuesday to toss a whistleblower suit accusing the company of violating the state's False Claims Act by overcharging government agencies for package deliveries, arguing that the suit is preempted by federal law.

DHL claimed that the suit, which alleges the company assessed government agencies a jet fuel surcharge on shipments that were ground delivered, is barred by the Airline Deregulation Act and the Federal Aviation Administration Authorization Act.
