Fed. Circ. Reverses CIT, Ups Magnesium Dumping Duties

Law360, New York (July 27, 2012, 5:02 PM EDT) -- Ruling that decreased anti-dumping duties approved by a lower court were erroneous, the Federal Circuit on Friday reinstated a higher duty rate on magnesium metal imported by Russia-based PSC VSMPO-Avisma Corp.

In an appeal by American magnesium producer US Magnesium LLC, the court held that Judge Judith M. Barzilay of the U.S. Court of International Trade improperly rejected the U.S. DepartmentCommerce 's 15.77 percent duty rate on Avisma and signed off on a recalculated 8.51 percent rate.
