2nd Circ. Knocks Down Buffalo Firefighters' Race Bias Suit

Law360, New York (July 30, 2012, 5:50 PM EDT) -- The Second Circuit on Monday shot down an appeal from a group of black firefighters who claimed that the city of Buffalo, N.Y., based its promotions on discriminatory tests, finding that the exams were sufficiently related to the job duties.

The appeals court voted 2-1 to uphold a lower court ruling that found, even though two exams used to assess lieutenant candidates had a disparate impact on black firefighters, Buffalo had designed the tests — used 10 to 14 years ago — with a business need...
