Kmart Settles With Sales Workers In Calif. OT Class Action

Law360, New York (July 31, 2012, 1:48 PM EDT) -- Sears Holdings Corp.'s Kmart Corp. on Monday reached a settlement in a wage and hour suit with a proposed class of sales coaches and sales managers who accuse the retailer of failing to provide them with overtime wages and proper break periods.

U.S. District Judge Phyllis J. Hamilton gave the green light to the $475,000 deal, which would go to a class of sales coaches, operations managers, merchandise managers and other similar employees who allege Kmart required or encouraged them to work more than 40 hours...
