Wal-Mart Project To Proceed After Calif. Court Backs City's OK

Law360, New York (July 31, 2012, 10:31 PM EDT) -- A California appeals court found Tuesday that despite several errors, the city of Rialto hadn't abused its discretion when it certified an environmental impact report for a 230,000-square-foot retail center to be anchored by a 24-hour Wal-Mart Inc. Supercenter.

Finding that errors and omissions don't invalidate a city's project approval in cases where the same outcome would have been reached even if the errors hadn't existed, the appeals court reversed a trial court decision that had blocked the project's authorization in a suit launched by Rialto...
