Nissan Ducks Most Of Faulty E-Key Suit In 9th Circ.

Law360, New York (August 6, 2012, 7:29 PM EDT) -- The Ninth Circuit on Thursday tossed most of a putative class action accusing Nissan North America Inc. of selling cars with a faulty electronic key system, finding a lower court was right to dismiss claims based on the Federal Motor Vehicle Safety Standards.

In an unpublished order, the appellate court found that a California federal court correctly dismissed with prejudice claims stemming from the FMVSS, agreeing with the lower court's finding that the plain language of the regulation made it clear that Nissan’s electronic key system...
