Toshiba Says ATM Fee Ruling Dooms LCD Antitrust Claims

Law360, New York (August 6, 2012, 4:32 PM EDT) -- Toshiba Corp. became the latest electronics component maker Thursday to raise the Ninth Circuit's recent ATM fee antitrust litigation ruling to try to nix claims from companies that bought finished products incorporating allegedly price-fixed parts, arguing the plaintiffs don't have standing to seek damages.

The company argues that a number of major direct action plaintiffs — including AT&T Corp., Dell Inc. and Target Corp. — accusing Toshiba and others of fixing prices for liquid crystal display panels shouldn't be allowed to seek damages under federal antitrust...
