Starbucks Asks 1st Circ. To Nix $14M Damages Over Tip Pool

Law360, New York (August 6, 2012, 12:47 PM EDT) -- Starbucks Corp. urged the First Circuit on Thursday to overturn a damages award of more than $14.1 million against it for a policy allowing shift supervisors to share in tip pools, saying the lower court erred in ruling shift supervisors had managerial responsibilities.

Starbucks' brief asked the appeals court to reverse a Massachusetts federal court’s order that granted a class of baristas $7.5 million in damages and prejudgment interest as well as $6.63 million in treble damages.
