5th Circ. Upholds Negligence Claims In Katrina Insurance Row

Law360, New York (August 6, 2012, 4:15 PM EDT) -- The Fifth Circuit on Friday allowed a real estate developer to go forward with professional negligence claims against an insurance agent it accused of botching a policy the company tried to use after Hurricane Katrina damaged its property.

The three-judge appeals panel upheld a lower court’s decision that Lowry Development LLC could proceed with the claims against Groves & Associates Insurance Inc. even though the district court had dismissed the claims with prejudice.
