Insurer Says Developers On Their Own In Nev. Class Action

Law360, New York (August 7, 2012, 7:25 PM EDT) -- St. Paul Fire and Marine Insurance Co. on Tuesday asked a judge to find it has no duty to cover the defense costs of two developers in an underlying class action that alleges the builders failed to address seismic engineering requirements for some homes in Nevada.

The insurer said Del Webb Communities Inc. and Terravita Home Construction Co. aren’t entitled to coverage because the class action claims are for “damage that results from the performance of or failure to perform architect, engineer or surveyor professional services,”...
