Dole, Others Beat Banana Farmers' Chemical Exposure Suit

Law360, New York (August 8, 2012, 8:07 PM EDT) -- A California state court on Tuesday dismissed Dole Food Co. Inc. and others from a suit brought by nearly 2,400 Filipino banana plantation farmers who claim their employers exposed them to a banned toxic pesticide, ruling the allegations are time-barred.

Judge Jane L. Johnson granted demurrers from Dole and the chemical companies Ameribrom Inc., Dead Sea Bromine Co. Ltd. and Bromine Compounds Ltd. In addition, Shell Oil Co., The Dow Chemical Co., Del Monte Fresh Produce Inc. and Occidental Chemical Corp. joined in Dole's demurrer....
