Howard Hanna Gets Real Estate Fee Suit Thrown Out

Law360, New York (August 10, 2012, 6:24 PM EDT) -- An Ohio federal judge has dismissed a proposed consumer class action lodged at Pennsylvania real estate company Howard Hanna Corp. and its subsidiaries over the alleged illegal splitting of fees in real estate transactions, according to a Thursday order.

Springboarding off a recent Supreme Court decision in Freeman v. Quicken Loans Inc. that said alleged improper fees must be split between two entities for an unearned fee to be actionable under the Real Estate Settlement Procedures Act, Judge Donald C. Nugent dismissed the case with prejudice...
