Dole Says False Labeling Suit Federally Preempted

Law360, New York (August 14, 2012, 4:07 PM EDT) -- Dole Food Company Inc. asked a California federal judge on Monday to toss a proposed consumer class action accusing the company of mislabeling its products as “all natural” and “low calorie," saying private citizens have no right to interpret or enforce U.S. Food and Drug Administration labeling regulations.
