Alleged Gang Member's Facebook Page Not Private, Judge Says

Law360, New York (August 14, 2012, 1:39 PM EDT) -- A federal judge on Friday said the government did not violate the Fourth Amendment rights of an alleged New York City gang member when it used one of his friends to access his personal Facebook page, where he allegedly posted on gang-related topics.

Defendant Melvin Colon, an alleged member of the Bronx-based Courtlandt Avenue Crew gang, had contested the propriety of the government's method of collecting evidence to support a probable cause determination that led to a warrant for the search of his Facebook account....
