Asarco Accused Of Hiding Behind Bankruptcy Cover

Law360 (October 9, 2007, 12:00 AM EDT) -- The U.S. government has attacked copper producer Asarco LLC, accusing the mining company of using its bankruptcy to avoid enormous environmental liabilities.

Filing a pretrial brief with the U.S. Bankruptcy Court for the Southern District of Texas on Friday, the government argued Asarco had “lost sight” of the goal of the Comprehensive Environmental Response, Compensation and Liability Act in challenging the value of cleanup claims.
