Texas Court Voids $1.4M Hail Damage Coverage Award

Law360, Dallas (August 15, 2012, 4:52 PM EDT) -- A Texas appeals court on Wednesday reversed a $1.4 million insurance award against U.S. Fire Insurance Co., ruling after a rehearing of the case that Lynd Co. shouldn’t have won summary judgment on its claims for hail damage to apartment complexes in Austin.

According to the court, a series of hailstorms hit Texas in spring 2006 that damaged, among others, two apartment complexes owned by Lynd Co. U.S. Fire paid out a $5 million insurance policy, but that wasn’t enough to cover the damage. Lynd Co....
