State Regulations Provide Antitrust Immunity, Blue Cross Says

Law360, Washington (August 21, 2012, 1:31 PM EDT) -- Blue Cross Blue Shield of Tennessee Inc. asked a federal judge to throw out a putative antitrust class action on Monday, claiming the insurance provider is immune to federal and state antitrust laws since state regulators approved the allegedly inflated premiums.

While the case, filed in May, alleged that the insurance company's dominant market share in Tennessee is the direct result of an illegal conspiracy between 37 of the nation's largest health insurance member plans and is designed to limit competition in various markets, BCBST said...
