Judge Reverses Consolidation Of Bayer FCA Suits

Law360, New York (August 22, 2012, 3:52 PM EDT) -- A New Jersey federal judge on Tuesday separated a consolidated false claims whistleblower lawsuit over allegations Bayer AG wrongly promoted off-label uses for its heart surgery drug Trasylol, saying the two relators can't proceed together.

Laurie Simpson and Timothy Daniels, both former Bayer employees, alleged in their consolidated qui tam complaint that Bayer had promoted off-label uses for Trasylol. The drug was only approved to reduce the use of blood transfusions during surgery by minimizing blood loss, before Bayer pulled it from the market.
