Deutsche, Others Say Destroyed Evidence Nixes Refco Suit

Law360, New York (August 22, 2012, 8:03 PM EDT) -- Deutsche Bank Securities Inc., accounting firm Grant Thornton LLP and other defendants asked a federal judge Tuesday to toss a hedge fund's lawsuit aimed at recovering money lost to the Refco Inc. fraud, saying a key witness destroyed binders full of evidence.

Christopher Rose, the former chief operating officer of investment manager PlusFunds Group Inc., disposed binders full of handwritten notes that could have been used to impeach his questionable testimony, the defendants said in a brief to U.S. District Judge Jed S. Rakoff.
