Troubled NJ Council Should Hear Housing Suit, Judge Says

Law360, New York (August 24, 2012, 9:01 PM EDT) -- A judge on Friday dismissed a K. Hovnanian entity's affordable housing lawsuit against Cedar Grove, N.J., citing a recent state appeals court decision that reinforced resolving such disputes before the state's troubled Council on Affordable Housing, rather than the courts.

Cedar Grove successfully sought dismissal of the case in Essex County Superior Court based on the New Jersey Appellate Division's July 19 decision in Wayne Property Holdings LLC v. Township of Wayne, which held that developers first must exhaust administrative remedies at COAH before going forward...
