8th Circ. Brings Back Ameren's $32M Dispute With Insurer

Law360, New York (August 27, 2012, 5:38 PM EDT) -- The Eighth Circuit on Monday revived Ameren UE's $32 million lawsuit against an excess insurer over claims arising from a reservoir wall collapse at a hydroelectric plant, instructing a lower court to determine whether sending the dispute to New York would violate Missouri public policy.

A Missouri federal court had tossed Ameren's suit in part because its second-layer excess insurance policy with Energy Insurance Mutual Ltd. specified that the U.S. District Court for the Southern District of New York would have exclusive jurisdiction over disputes....
