10th Circ. Tosses Boeing, Spirit Worker Age Bias Suit

Law360, New York (August 27, 2012, 7:38 PM EDT) -- The Tenth Circuit on Monday rejected a bid to revive an age discrimination suit by a proposed class of employees accusing The Boeing Co. and Spirit AeroSystems Inc. of illegally terminating older workers, finding the workers had failed to demonstrate a pattern of discrimination.

In a unanimous, published opinion, the appeals court upheld a Kansas federal judge’s grant of summary judgment to Boeing and Spirit, saying the employees’ evidence showed only “isolated or sporadic instances of age discrimination.”
