Bank Can't Collect $195M Guaranty On Colo. Project: Judge

Law360, New York (August 28, 2012, 8:41 PM EDT) -- A New York state judge said Monday that it was premature for a German bank to try to collect on part of a $194.7 million guaranty for a failed Colorado ski development project, saying the creditor hadn't shown why it had continued funding a loan to the developer The Related Cos. LP.

Judge Charles E. Ramos said that it was too early for summary judgment on lender Hypo Real Estate Capital Corp.'s first claim to force Related to pay the first $32.5 million of the guaranty....
