Gentiva Clinicians Denied Class Cert. In OT Lawsuit

Law360, New York (August 30, 2012, 1:32 PM EDT) -- A Georgia federal judge on Wednesday refused to certify a class of clinicians who claim that Gentiva Health Services Inc. violated North Carolina labor laws by failing to pay overtime wages, saying that their claims were too individualized.

U.S. District Judge Steve C. Jones denied a motion seeking class certification for a class of clinicians — which include registered nurses, physical therapists and occupational therapists — under the North Carolina Wage and Hour Act, saying that doing so would render the case unmanageable.
