Fla. Appeals Court Kills $400M Resort Development

Law360, New York (August 30, 2012, 5:07 PM EDT) -- Florida's Second District Court of Appeal ruled Wednesday that a lower court did not exceed its jurisdiction by reversing a town council's approval of a $400 million resort expansion in Florida, according to a published opinion.

A lower court did not improperly reweigh evidence to find a reason to block the controversial development, nor did it misinterpret the precedent set by an earlier, related case, said Judge Edward C. LaRose, with Judges Nelly N. Khouzam and Anthony K. Black concurring.
