LA Fitness Can't Ditch Suit Over Cancellation Policy

Law360, New York (September 5, 2012, 8:05 PM EDT) -- A New Jersey federal judge on Tuesday refused to toss certain consumer protection claims from a putative class action accusing LA Fitness International LLC of subjecting members to unlawful fees and an unreasonable cancellation policy.

Construing Sophia Martina's complaint in a light most favorable to the plaintiff, U.S. Judge William H. Walls found that there were sufficient facts to support a claim under the New Jersey Consumer Fraud Act.
