Ceva Freight Beats Class Cert. In Truckers' OT Suit

By Bill Donahue (September 10, 2012, 5:25 PM EDT) -- A California federal judge on Friday refused to certify a class of truck drivers who claim Ceva Freight LLC improperly labeled them independent contractors, ruling that the long-running case would require too much individual analysis.

U.S. District Judge Ronald M. Whyte said common questions would not predominate when determining whether Ceva Freight's drivers' situations indicated that they were operating a distinct business. Some drivers hired their own teams of their own subemployees, while others worked almost directly as employees, the court said.
