Wells Fargo Loan Processor Loses Cert. Bid In OT Suit

Law360, Dallas (September 12, 2012, 9:48 PM EDT) -- A Texas federal judge denied class certification Wednesday in a loan processor's Fair Labor Standards Act suit alleging Wells Fargo Bank NA was a "repeat offender" of federal labor laws and failed to pay employees overtime and maintain accurate records.

U.S. District Judge Melinda Harmon said lead plaintiff Rose Griffith hadn't shown that loan processors nationwide were similarly situated for FLSA class treatment because she had failed to allege Wells Fargo subjected them to uniform pay practices or policies that violated the act.
