GrafTech Fires Back At Insurers In Chemical Exposure Suits

Law360, New York (September 19, 2012, 3:26 PM EDT) -- Graphite products manufacturer GrafTech International Ltd. on Tuesday asked a New York federal judge to toss a lawsuit filed by several insurers seeking to avoid covering the company in underlying bodily injury cases centered on employees’ alleged exposure to harmful chemicals.

The insurers, ACE American Insurance Co., ACE Property & Casualty Insurance Co., Insurance Co. of North America, Indemnity Insurance Co. of North America and Pacific Employers Insurance Co., filed a suit in August seeking a declaratory judgment that they don’t have to provide coverage to GrafTech...
