Supplement Maker Can't Skirt Suit Over Arthritis Drink Claims

Law360, New York (September 20, 2012, 9:18 PM EDT) -- A California federal judge on Wednesday shut down a motion to dismiss a proposed class action against Supple LLC, thwarting the supplement maker's second attempt to toss claims that a drink it markets at lessening the effects of arthritis is little better than juice.

U.S. District Judge Michael W. Fitzgerald gave the go-ahead to plaintiff Arleen Cabral to proceed with her amended complaint against Supple, ruling that she had overcome the problems that had caused her initial January 2012 complaint to be tossed.
