7th Circ. Broadens ERISA Whistleblower Protections

Law360, New York (September 24, 2012, 6:11 PM EDT) -- An Employee Retirement Income Security Act provision preventing employers from retaliating against workers who protest meddling with their pensions includes informal communications as well as formal legal action, the Seventh Circuit has ruled.

The appeals court on Sept. 4 vacated an Indiana federal court's determination that Victor George's complaints to employer Junior Achievement of Central Indiana Inc. about its alleged failure to deposit his withheld pay in his retirement account did not constitute an “inquiry” under ERISA, saying such informal proceedings do trigger the statute's protections....
