7th Circ. Revisits Widower's ERISA Suit Over Medical Bills

Law360, Chicago (September 27, 2012, 4:12 PM EDT) -- Attorneys for a health insurance company and the widower of an insured faced a fresh round of questions Thursday from Seventh Circuit judges, who are reconsidering en banc a suit alleging the insurer unfairly left the widower with $80,000 in medical bills after his wife's death.

Twelve appellate court judges heard oral arguments in the case after vacating a 2-1 panel decision from April that had largely refused to hold Illinois-based Concert Health Inc. liable for alleged violations of the Employee Retirement Income Security Act....
