BofA Workers Win Class Cert. In Wage-And-Hour MDL

Law360, New York (September 28, 2012, 6:14 PM EDT) -- A Kansas federal judge on Thursday conditionally certified an opt-in class of as many as 227,000 retail banking center employees in multidistrict litigation accusing Bank of America NA of violating the Fair Labor Standards Act by requiring off-the-clock work.  

U.S. District Judge John W. Lungstrum conditionally certified a nationwide opt-in FLSA class, but refused to certify opt-out classes to bring California and Washington state law claims.

The FLSA class includes all nonexempt workers employed in BofA's retail banking centers nationwide from October 2006 to the present....
