WellPoint Ducks Some Claims In Unfair Premium Hike Suit

Law360, New York (October 1, 2012, 3:14 PM EDT) -- An Illinois federal judge on Thursday trimmed a number of claims from a putative class action accusing several WellPoint Inc. units of unfairly overcharging or cutting off coverage for former Rightchoice Managed Care Inc. customers after purchasing the company.

U.S. District Judge J. Phil Gilbert dismissed an Illinois Health Insurance Portability and Accountability Act claim by plaintiffs Charlotte Phillips and Bob Myrick over alleged unfair discontinuation of coverage by WellPoint subsidiary Unicare, saying the statute doesn’t allow for a private right of action.
