Judge Certifies Just Calif. Class In Kaz Heating Pad Suit

Law360, New York (October 5, 2012, 8:07 PM EDT) -- A California federal judge on Friday granted certification to a class of California consumers accusing Kaz USA Inc. of using deceptive labeling and advertising to trick consumers into purchasing heating pads that inflicted painful burns, but shot down a proposed Pennsylvania class.

U.S. District Judge Marilyn L. Huff said the California claims share a common contention and deal with similar alleged defects, meriting certification, but that Pennsylvania law sets the bar for consumers too high to allow for a class in this case.
