Disney Urges Dismissal of 'Drastic' Clean Water Act Suit

Law360, New York (October 5, 2012, 10:02 PM EDT) -- An attorney for Walt Disney Co. told a California judge Friday that environmentalists had taken a "drastic” position in suing the company for alleged Clean Water Act violations, saying Congress never intended that movie studios should be governed by the federal storm water program.

The environmentalists claim storm water and landscape irrigation runoff from Disney's 51-acre production facility in Burbank, Calif., is polluted with zinc and copper. They say the studio should obtain a National Pollutant Discharge Elimination System permit if it wishes to continue discharging...
