3rd Circ. Backs Card Check Organizing At Rite Aid Stores

Law360, New York (October 17, 2012, 4:01 PM EDT) -- The Third Circuit on Tuesday refused to disturb an arbitration decision that drugstore chain Rite Aid of New Jersey Inc. had to recognize union representation at five stores based on the so-called card check process, ruling that it didn't clash with the parties' labor agreements.

Rite Aid said a 2005 collective bargaining agreement with United Food and Commercial Workers Union Local 1360 gave it unfettered discretion to recognize union representation through a National Labor Relations Board election or other means that the company found "acceptable." But...
