5th Circ. Rules DR Horton Not Liable For Faulty AC Units

Law360, New York (October 18, 2012, 4:46 PM EDT) -- The Fifth Circuit on Wednesday upheld the dismissal of a class action against developer DR Horton accusing the company of installing faulty air conditioners in homes, saying the law it was brought under only applies to damage from construction defects.

The appeals court affirmed a ruling from Louisiana district court tossing the suit — which claims that Horton installed an air conditioner with insufficient capacity in a home bought by plaintiff Mike Gines — after determining that the Louisiana New Home Warranty Act provides remedies only...
