Enbridge Wins New Trial In Texas Pipeline Property Fight

Law360, New York (October 18, 2012, 6:47 PM EDT) -- A Texas appeals court tossed a jury verdict Wednesday against Enbridge Pipelines (East Texas) LP and ordered a new trial in the company’s contract dispute over its pipeline that allegedly ruined a couple's picturesque 153-acre tract of land.

The Tyler, Texas, appeals panel ruled that the lower court erred when it failed to ask the jury to determine whether the injury to Gilbert and Katherine Wheeler’s property was temporary or permanent.
