NY High Court Boots Town's Suit Over Zoning Bias Probe

Law360, New York (October 18, 2012, 11:05 PM EDT) -- Oyster Bay, N.Y., must exhaust administrative remedies before suing the New York State Division of Human Rights over the agency's investigation into the town's potentially discriminatory zoning laws, the state's high court ruled Thursday in affirming the dismissal of the town's suit.

New York's Court of Appeals ruled that the town must first use administrative remedies to pursue its claim that DHR is engaged in reverse discrimination because the allegations require that factual issues be resolved before being presented to a court.
