Cuban Wants SEC's Expert Witness Out Of Insider Trading Case

Law360, New York (October 22, 2012, 2:55 PM EDT) -- Dallas Mavericks owner Mark Cuban on Friday moved to bar the input of an expert witness for the U.S. Securities and Exchange Commission in a suit accusing the billionaire of insider trading, arguing that the expert's rebuttal report contradicts settled issues of law in the case.

Cuban argues that in a July 2009 opinion, the court ruled that a duty sufficient to establish liability under the misappropriation theory of insider trading could come about by agreement only if Cuban made agreements to keep certain information secret...
