Tech Giants Back EMC In Fight Over Patent Suit Venue

By Ryan Davis (October 25, 2012, 6:40 PM EDT) -- Google Inc. and other tech giants on Tuesday joined EMC Corp. in asking the Federal Circuit to overturn a Texas federal judge's ruling that EMC couldn't transfer a patent suit against it, saying the ruling sets a precedent that makes it too difficult to transfer cases.

The companies filed an amicus brief supporting EMC's petition for writ of mandamus, filed Oct. 16, which argues U.S. Magistrate Judge Amos L. Mazzant abused his discretion in August by refusing to let EMC transfer a data storage patent suit by nonpracticing entity Oasis Research LLC to a court more convenient for EMC.
