Film Workers Ask High Court To Mull Private FLSA Settlement

Law360, New York (October 26, 2012, 3:22 PM EDT) -- Members of the movie crew for “Spring Break '83” are asking the U.S. Supreme Court to review the dismissal of their claims for unpaid wages, saying the Fifth Circuit's decision to accept a private Fair Labor Standards Act settlement created a circuit split.

The Fifth Circuit held in July that a union-negotiated settlement precluded four union members who worked as lighting and rigging technicians on the film from bringing unpaid wage claims, even though the deal had never been approved by a court or the U.S....
